Message dated April 16 was read stating the House passed and                                                                    
returned for consideration CS FOR SENATE BILL NO. 117(L&C)                                                                      
"An Act requiring the Department of Revenue to set the minimum                                                                  
price for cigarettes for sale by wholesalers and retailers; and                                                                 
prohibiting a wholesaler or retailer from selling at wholesale or retail                                                        
cigarettes at a lower price than the price set by the Department of                                                             
Revenue" with the following amendment:

Senator Ellis moved that the Senate concur in the House amendment.                                                              
                                                                                                                                
The question being: "Shall the Senate concur in the House

requiring the Department of Revenue to set the minimum price for                                                                
cigarettes for sale by wholesalers and retailers; and prohibiting a                                                             
wholesaler or retailer from selling at wholesale or retail cigarettes at a                                                      
lower price than the price set by the Department of Revenue."                                                                   
                                                                                                                                
The Secretary was requested to notify the House.                                                                                
                                                                                                                                
The bill was referred to the Secretary for enrollment.
